Know about Trademark Objection
Trademark Objection are the cases wherein the Trade Mark Registrar raises an objection for registration of a trademark, the applicant has an opportunity to submit a written reply for the objection raised. The reply to the Trademark Examination Report should contain reasons, facts and evidences as to why the mark should be registered in favor of the applicant along with supporting evidence, if any. If the Trademark Examiner finds the reply sufficient and addresses all the concerns raised by him/her in the Examination Report, the application would be allowed to be published in the Trademark Journal, before registration.
1. What is Trademark Examination?
Trademark Examination is a thorough preliminary checking of Trademark Application filed in TM-A which is conducted by the examiner. If the application is objected, an examination report is sent to the Applicant or published in its Official site.
2. Who is an Examiner?
An Examiner includes any officer who is authorised with the duty of examination of Trademark Applications.
3. What is the deadline to reply the report?
The deadline to file Trademark objection reply or Examination report Reply is thirty days of the date of issuance of the report to the applicant or thirty days of viewing the objection status online.
4. Who issues the Examination report?
The Trademark examiners appointed by Government at Trademark registry, issues the examination report.
5. Even after filing Trademark examination reply the status is still shown objected. What to do?
Once you file a trademark examination reply, it might take 6-7 months for the examiner to look at the reply filed and the status will be changed after the examiner can analyze the reply filed. It does take 6-7 months for the status to be changed from objected to next step, which is acceptance or rejection.
6. I missed my Trademark examination reply deadline, but the status is still shown as objected. Can I file the reply now?
Yes, as long as the status is shown objected the applicant is eligible to file the reply to the examiner. However, the deadline should be taken seriously.
